My friend adopted a dog from me, the dog had some issues but has trained really well. Anyway when she first had him, fourteen months ago her daughter left the front door open, the postman came to the door and the dog nipped the back of her leg. My friend asks her if she wanted to come in and looked at her leg. The skin was not broken, and the post woman said that she was fine and left. My friend expected to get a letter from the post office saying that they would not deliver to her ... never heard anything till today. A letter from post office union saying they are suing her for damages. Fourteen months on. No communication at all in all that time, my friend has seen the woman doing her job subsequently and nothing has been said. My friend does not have a great deal of money and doesn't know what to do. Is there someone I can speak to.

Has she got any sort of free legal advice via one of her insurances? Eg house or car or dog? I know mine come with an advice line where you can ring and ask advice on stuff. Totally unrelated to that policy too, just any legal advice.

Check household insurance for cover. Not a member of Dogs Trust by any chance?

Other options:
Trevor Cooper - Dog Law
DDAWatch? Not sure if they are more about Section 1 than 3 though?

Or is this under the Dogs Act 1871?

As it comes from the union and is addressed to the occupier i am guessing but not sure it is a civil compensation claim.

probably not what you wanted to see but will give your friend an idea of what to expect. would suggest she gets an outside box too to stop post office from refusing to deliver and maybe a dog gate inside to stop dog getting out, thats what i have and have had for years. i used to have one of those cage things on the back of our old door but honey our bridge dog would rag it with her teeth so obv i had to get rid of it and when we had a new door fitted i opted not to have a letter box put in.

The entire damages culture depresses me beyond belief. When I was young if a dog bit you it bit you , nobody would have dreamt of making money out of it. Not saying someones dog should be able to bite but I find the entire thing depressing.

The problem is that she was moving into the house that day, her daughter moving things in left the door open. She has a porch which stops any contact with post, and he never is allowed to run to the door and out as he did that day. It really was a fluke situation that day. The skin was not broken. The post woman did not lose time off work. And has since regularly said hello. There has been no official contact in the fourteen months since the event. I know being nipped isn't nice but it is not life threatening either. With the clamp down on whip lash compensation I presume this is the next thing for leeches of society. :bash:

That's really poxy, when I was assaulted at work, punched, then hit with fire extinguisher, cab door kicked in whilst he was screaming he was going to kill me ( oh and all I did was stop him from smashing a passengers head in with extinguisher) then I turned into a bit of a wreck and got diagnosed with ptsd anyway I didn't sue him (which was pointless anyway) or work either. Union solicitors did try to encourage me to, I did get money from criminal injuries board, first offer as I didn't want it really and saw it as a horrid reminder but I agree sueing in your friends case well its obv all about money and nothing else and yes it is disgusting and even a bit callous maybe.

Hi Sorry to hear about your friend , one of my dogs bit my post lady , broke the skin and needed stitches .. I said I was sorry sent the post lady a bouquet of flowers , I also had a letter and a visit from the police . I never heard any more .

I think these things get blown out of proportion , tell your friend not to worry , plead poverty like others and if the worse should happen pay a fiver a week !

If it does go that far , have a case ready that you have a locked gate ..you've made changes etc .. assuring them it will never happen again , its just one of those things , being in the wrong place at the wrong time .
